根據《中華人民共和國憲法》第三十一條，國家在必要時得設立特別行政區。在特別行政區內實行的制度按照具體情況由全國人民代表大會以法律規定。

在此憲法基礎上，全國人民代表大會在1990年4月4日通過了《中華人民共和國香港特別行政區基本法》（《基本法》），奠定了「一國兩制」、「港人治港」和高度自治的基本方針政策。《基本法》包括正文九個章節共160條條文以及三個附件，規定了香港特別行政區實行的制度，於1997年7月1日香港特別行政區成立當天生效。

今年是《基本法》頒布三十周年，本展覽展示《基本法》頒布30年來的重要里程，回顧《基本法》的歷史背景、起草和頒布過程，以及香港成功落實《基本法》的情況。

Pursuant to Article 31 of the Constitution of the People's Republic of China, the state may establish special administrative regions when necessary. The systems instituted in special administrative regions shall, in light of specific circumstances, be prescribed by laws enacted by the National People's Congress.

On this constitutional basis, the National People's Congress adopted the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China (“Basic Law”) on 4 April 1990, establishing the basic policies of “one country, two systems”, “Hong Kong people administering Hong Kong” and a high degree of autonomy. The Basic Law, which came into effect on 1 July 1997, when the Hong Kong Special Administrative Region (“HKSAR”) was established, prescribes the systems practised in the HKSAR in nine chapters with a total of 160 articles and three annexes.

This year marks the 30th anniversary of the promulgation of the Basic Law. This exhibition presents the key milestones since the promulgation of the Basic Law, and introduces the historical background of the Basic Law, its drafting, promulgation and successful implementation in Hong Kong.

Hong Kong has been part of the territory of China since ancient times; it was occupied by Britain after the Opium War in 1840. On 19 December 1984, the Chinese and British Governments signed the Joint Declaration on the Question of Hong Kong, affirming that the Government of the People's Republic of China will resume the exercise of sovereignty over Hong Kong with effect from 1 July 1997, thus fulfilling the long-cherished common aspiration of the Chinese people for the recovery of Hong Kong.

Upholding national unity and territorial integrity, maintaining the prosperity and stability of Hong Kong, and taking account of its history and realities, the People's Republic of China has decided that upon China's resumption of the exercise of sovereignty over Hong Kong, a Hong Kong Special Administrative Region will be established in accordance with the provisions of Article 31 of the Constitution of the People's Republic of China, and that under the principle of “one country, two systems”, the socialist system and policies will not be practised in Hong Kong.

In accordance with the Constitution of the People's Republic of China, the National People's Congress hereby enacts the Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China, prescribing the systems to be practised in the Hong Kong Special Administrative Region, in order to ensure the implementation of the basic policies of the People's Republic of China regarding Hong Kong.

In 1856 the British-French allied troops initiated the second Opium War. In 1860, Britain forced the Qing government to sign the Treaty of Beijing, ceding the tip of the Kowloon Peninsula.

In 1898 taking advan tage of western imperialist powers scrambling to carve up Chinese territory, Britain again forced the Qing government to sign the “Convention for the Extension of Hong Kong Territory” that compelled China to lease to Britain the vast northern section of the Boundary Street of the Kowloon Peninsula, plus more than 200 nearby islands (later collectively known as the New territories). This 99-year lease would expire on 30 June 1997. The Chinese people have consistently opposed the three unequal treaties mentioned above.

After the founding of the People's Republic of China, the Chinese Government has consistently stated its position that Hong Kong has been part of Chinese territory and China does not recognise the three unequal treaties imposed on China by the imperialists. The Chinese Government has consistently held that at the appropriate time, a negotiated solution to the question would be found; until then, the status quo would be maintained.

At the 26th Session of the United Nation General Assembly held on 25 October 1971, the so-called “important question motion” put forward by the United States was overruled and the resolution that recognised the People's Republic of China as the only legitimate representative of China to the United Nations was passed by an overwhelming majority. UN representatives applauded when the resolution was passed.

中英兩國政府關於解決香港問題的談判分兩個階段：
第一階段從1982年9月英國首相戴卓爾夫人訪華至1983年6月，雙方主要就原則和程序問題進行會談；第二階段從1983年7月至1984年9月，兩國政府代表團就具體實質性問題進行了二十二輪會談。

中英两国政府关于解决香港问题的谈判分两个阶段：
第一阶段从1982年9月英国首相戴卓尔夫人访华至1983年6月，双方主要就原则和程序问题进行会谈；第二阶段从1983年7月至1984年9月，两国政府代表团就具体实质性问题进行了二十二轮会谈。

Negotiations between the Chinese and British governments on Hong Kong were divided into two stages: the first stage began in September 1982, when British Prime Minister Margaret Thatcher visited China, to June 1983; the two sides engaged mainly in discussions regarding matters of principle and procedures. The second stage was from July 1983 to September 1984, when delegations of the two governments held 22 rounds of talks on concrete and substantive issues.

4 December 1982 The Fifth National People's Congress adopted at its fifth meeting the present Constitution of the People's Republic of China, adding Article 31 which stipulates that “the state may establish special administrative regions when necessary. The systems instituted in special administrative regions shall, in light of specific circumstances, be prescribed by laws enacted by the National People's Congress”. This provides the constitutional basis for resolving issues of national unity, including those concerning Hong Kong.

18 September 1984 The two sides reached agreement on all matters. On 26 September 1984, a Sino-British Joint Declaration on the Question of Hong Kong and three Annexes were initialed. Negotiations between the Chinese and British governments on Hong Kong, which had lasted for two years, came to a successful conclusion.

A six-member group tasked to draft the constitution of the Basic Law Consultative Committee (BLCC) held its second meeting on 26 July 1985. In a press briefing after the meeting, BLCC Member Simon Li Fook-sean told the media that the meeting had reached consensus on a number of issues concerning the draft constitution. The six members are (from left to right): Mo Kwan-nin, Dorothy Liu Yiu-chu, Simon Li Fook-sean, Martin Lee Chu-ming, Maria Tam Wai-chu and Szeto Wah.

28 April 1988 “The Draft Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China for Solicitation of Opin ions” was published in Hong Kong. The BLCC thereupon conducted a five-month public consultation exercise. The second draft was published in February 1989, and the subsequent consultation period ended in October 1989. Through these two consultation exercises, the Committee received nearly 80,000 submissions and suggestions.

A member of the public took a copy the “Draft Basic Law of the Hong Kong Special Administrative Region of the People's Republic of China (for Solicitation of Opinions)” at the office of the Basic Law Consultative Committee. The document was distributed at over 900 locations in Hong Kong on 29 April 1988.

On 16 February 1990, the ninth meeting of the Basic Law Drafting Committee passed a resolution on the draft Basic Law and the revised designs of the regional flag and emblem by a two-thirds majority (34 votes) to adopt entry no. 2 (middle) as the flag and emblem of the HKSAR.

26 June 1999 The Standing Committee of the Ninth National People's Congress adopted at the Tenth Session the Interpretation of Articles 22(4) and 24(2)(3) of the Basic Law. The Interpretation makes clear that the provision of Article 24(2)(3) regarding “persons of Chinese nationality born outside Hong Kong of those residents listed in categories (1) and (2)”, means both parents of such person, whether born before or after the establishment of the HKSAR, or either of such parents must have fulfilled the conditions prescribed in Article 24(2)(1) or (2) of the Basic Law at the time of their birth. For children of Chinese nationality born in the Mainland, only those whose parents or one of such parents had become permanent residents of Hong Kong at the time of their birth would have the right of abode, and that it is mandatory for them to apply to the relevant Mainland authorities for approval to enter Hong Kong.

2003 The Mainland and Hong Kong Closer Economic Partnership Arrangement (CEPA) is the first free trade agreement ever concluded by the Mainland and Hong Kong. The main text of CEPA was signed on 29 June 2003.

In the years that followed, the content of CEPA has been broadened and enriched, and CEPA has now been upgraded to become a comprehensive and modern free trade agreement covering four major areas, viz. trade in goods, trade in services, investment, and economic and technical cooperation.

6 April 2004 The Standing Committee of the Tenth National People's Congress adopted at the Eighth Session the Interpretation of Article 7 of Annex I and Article III of Annex II to the Basic Law. This interpretation is about the method for the selection of the Chief Executive and the method for the formation of the Legislative Council after 2007. The Interpretation makes clear that the provisions in the two aforementioned Annexes that any amendment must be made with the endorsement of a two-thirds majority of all the members of the Legislative Council and the consent of the Chief Executive and shall be reported to the Standing Committee of the National People's Congress for approval or for the record outline the legislative process that must be gone through before the method for selecting the Chief Executive and the method for forming the Legislative Council and its procedures for voting on bills and motions are to be amended. Such an amendment may become effective only if it has gone through the said process, including the approval finally given by the said Committee in accordance with law or the reporting to the Committee for the record. The Interpretation sets out clearly the procedural requirements for Hong Kong's further constitutional development.

27 April 2005 The Standing Committee of the Tenth National People's Congress adopted at the Fifteenth Session the Interpretation of Paragraph 2, Article 53 of the Basic Law, which makes it clear that in the event that the office of the Chief Executive became vacant, the term of office of the new Chief Executive should be the remainder of the previous Chief Executive.

26 August 2011 The Standing Committee of the Eleventh National People's Congress adopted at the Twenty Second Session the Interpretation of Paragraph 1, Article 13 and Article 19 of the Basic Law. The Interpretation confirms that in accordance with Article 13(1) of the Basic Law that “the Central People's Government shall be responsible for the foreign affairs relating to the Hong Kong Special Administrative Region”, the conduct of the foreign affairs relating to the HKSAR falls within the power of the Central People's Government. The Central People's Government has the power to determine the rules or policies on state immunity to be applied in the HKSAR. According to Article 19 of the Basic Law, the courts of the HKSAR have no jurisdiction over the act of the Central People's Government in determining the rules or policies on state immunity which concerns the conduct of foreign affairs. The HKSAR, including the courts of the HKSAR, is under a duty to apply or give effect to the rules or policies on absolute state immunity adopted by the Central People's Government.

10 June 2014 The State Council published the White Paper on “The Practice of the ‘One Country, Two Systems’ Policy in the HKSAR”, which provides a systematic review of the process and achievements of the implementation of “one country, two systems” in the HKSAR. It reiterates the core elements of the “one country, two systems” principle, explains the Basic Law, and highlights the principle that the Constitution and the Basic Law together constitute the constitutional basis of the HKSAR. The White Paper states that the Central Government exercises overall jurisdiction over the HKSAR, including the powers directly exercised by the Central Government, and the powers delegated to the HKSAR by the Central Government to enable it to exercise a high degree of autonomy in accordance with the law.

In his speech at the Inaugural Ceremony, President Xi stated that “the central government will never waver in its commitment to “one country, two systems” and make sure that it is fully applied in Hong Kong without any distortion or alteration. This will enable us to keep advancing in the right direction…Now that Hong Kong has returned to China, it is all the more important for us to firmly safeguard China's sovereignty, security and development interests. In conducting day-to-day affairs, we must have a strong sense of ‘one country’ and firmly observe the ‘one country’ principle, and thereby correctly handle the relationship between the HKSAR and the central government. Any attempt to endanger China's sovereignty and security, challenge the authority of the central government and the sanctity of the Basic Law of the HKSAR, or use Hong Kong as a channel for infiltration and sabotage against the mainland, is an act that crosses the red line, and is absolutely impermissible…on the basis of ‘one country’, the ‘two systems’ should and can stay in harmony and reinforce each other. We must adhere to ‘one country’ and respect the differences of the ‘two systems’, uphold the power of the central government and ensure a high degree of autonomy in the HKSAR, give play to the role of the mainland as a staunch supporter of Hong Kong and enhance Hong Kong's own competitiveness. At no time should we focus only on one aspect to the neglect of the other. Only in this way can we ensure that the ‘one country, two systems’ ship will maintain a steady course and reach its destination despite any rough seas.”

President Xi also pointed out that “one country, two systems” is the greatest advantage of Hong Kong, and the reform and opening up of the country is the largest stage for Hong Kong. 4 December 2018 Shen Chunyao, chairman of the Legislative Affairs Commission of the National People's Congress Standing Committee and chairman of the HKSAR Basic Law Committee, said in his speech at the Constitution Day Seminar that “ ‘one country, two systems’ is a complete concept in which ‘one country’ is the prerequisite and basis for implementing ‘two systems’, and the ‘two systems’ exist within ‘one country’. The Constitution of the country is the highest manifestation of ‘one country, two systems’ in the rule of law of the country. The Constitution has supreme legal status, legal authority and legal power. The people of all ethnic groups, all state organs and all relevant parties in the country must uphold the sanctity of the Constitution and ensure its compliance… Hong Kong's return to the motherland has brought about a significant change to the constitutional order of Hong Kong. The Constitution – the fundamental and supreme law of the country, and the Basic Law – the basis of various systems, policies and laws in Hong Kong, together form the constitutional basis of the political structure, legal systems and governance of the HKSAR.”

18 February 2019 The Central Government promulgated the Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area (“Outline Development Plan”), which sets out the directions guiding the development of the Guangdong-Hong Kong-Macao Greater Bay Area (Greater Bay Area). One of the six basic principles expounded in the Outline Development Plan is to adhere to “one country, two systems”, “stay committed to the basis of ‘one country’ and leverage the benefits of ‘two systems’; to act strictly in a ccordance with the Constitution and the Basic Laws; and to integrate the needs of the country with the strengths of Hong Kong and Macao, fully leverage the market-driven mechanism, foster complementarity among Guangdong, Hong Kong and Macao, and achieve joint development.”

自香港回归祖国以来，实践充分证明「一国两制」是香港保持长期繁荣稳定的最佳制度安排。香港在国家过去42年的改革开放过程中积极参与，充分发挥「一国」之利、「两制」之便的优势，巩固和提升了香港的传统优势产业，并大力推动新兴产业。在受惠于国家高速发展所带来的机遇的同时，香港亦为国家贡献资金、技术、人才、国际市场经验等，推进了国家的改革开放。

Since Hong Kong's return to the motherland, the implementation of the “one country, two systems” principle fully demonstrates that it is the best institutional arrangement to ensure Hong Kong's long term prosperity and stability. Leveraging on the advantages of “one country” and “two systems”, Hong Kong has played an active role in the past 42 years of the country's reform and opening up, strengthening our traditional competitive industries and growing emerging ones. While we benefitted from the opportunities arising from the rapid development of our country, Hong Kong also contributed to the reform and opening up of the country by providing capital, skills, talent, and experience in international market, etc.

展望未來，香港會繼續嚴格按照「一國兩制」的方針和《基本法》的規定，實行「港人治港」、高度自治。另一方面，香港會繼續加強市民對《憲法》和《基本法》的認識，積極參與國家經濟、政治、文化、社會、生態文明的建設。我們亦會把握粵港澳大灣區發展和「一帶一路」項目帶來的新機遇，為香港的未來發展拓展新空間，注入新動力，進一步推動「一國兩制」的新實踐。

展望未来，香港会继续严格按照「一国两制」的方针和《基本法》的规定，实行「港人治港」、高度自治。另一方面，香港会继续加强市民对《宪法》和《基本法》的认识，积极参与国家经济、政治、文化、社会、生态文明的建设。我们亦会把握粤港澳大湾区发展和「一带一路」项目带来的新机遇，为香港的未来发展拓展新空间，注入新动力，进一步推动「一国两制」的新实践。

Looking ahead, Hong Kong will continue to exercise “Hong Kong people administering Hong Kong” and a high degree of autonomy in strict accordance with the “one country, two systems” principle and the Basic Law. Besides, Hong Kong will continue to enhance the public's understanding of the Constitution and the Basic Law; participate actively in the economic, political, cultural, social and ecological development of the country; and seize new opportunities arising from the Greater Bay Area development and Belt and Road Initiative to provide new impetus for Hong Kong's future development and write a new page for the implementation of “one country, two systems”.
